
Well here we go again, AT&T and Apple have been sued yet again by a consumer complaining of being duped into believing that multimedia messaging, or MMS, was already available on the iPhone.
The latest complaint has been filed in the Northern District of Ohio on Wednesday (PDF hosted by Wired), plaintiff Deborah Carr says Apple and AT&T misled the public into believing that the iPhone 3GS was capable of sending and receiving MMS messages on the device. The lawsuit claims that Apple’s “print and video advertisements…on television, the Internet, the radio, newspapers, and direct mailers” all mention the availability of MMS on the device.
Two similar cases–one in Illinois and another in Louisiana–were also filed against the companies in August.
“We absolutely will offer MMS on iPhone 3GS and iPhone 3G with 3.0 upgrades in late summer, once we complete some system upgrades that will ensure our customers have the best experience with MMS,” an AT&T representative said in a statement cited by Wired.


















I agree with Denise. I can’t believe it has been this long… I still blame AT&T for this. Like I said before, it is the worse thing that iPhone can’t do in the States.
Coming this summer. When does AT&T believe summer ends and fall begins?September is in 2 days then what excuse will they use. Fraud is all I can say.
I hope these people win their court cases at least against AT&T. It’s rediculous that AT&T has not even allowed partial use of MMS. I’ve read they have to update every single AT&T iPhone customers account to opt in for MMS or something to that affect. That’s bull and they should give the power to the customer that owns an iPhone. Of course that’s IF AT&T really is doing what I’ve read.
I’ve hacked my iPhone 3GS a few times and have had MMS working but lose visual voicemail when I’ve done it and there are other annoyances this causes. It’s a real f**king hassle. So I’m all for punishing AT&T. I don’t really see how Apple is at fault. Maybe Apple should have chosen a better mobile carrier in the USA. I’ll fault them for that at least. Too bad Verizon turned Apple down originally…
